Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and LaxIQ.net (the "Service"), operated by Garret Manno (the "Operator," "we," "our," or "us") from Winter Park, Florida, United States. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you are participating in the LaxIQ.net early-access or beta program, the Early-Access Terms also apply and, where they conflict, control over these Terms.
1. Pre-Launch Status & Forward-Looking Statements
The Service is in active development. Features, interfaces, content, and availability may change without notice. Some features described on this site, in emails, in blog posts, or in marketing material are planned but not yet built. You should treat any reference to a future capability as a forward-looking statement, not a promise of delivery on any timeline.
We may add, remove, modify, delay, or never ship any feature, in our sole discretion. You will not be entitled to any refund, credit, or compensation because a feature changed, was removed, or never shipped.
How to read these Terms
These Terms describe our intent and best-effort practices, not absolute guarantees. Where the Terms say "we will," read it as "we intend to and will use reasonable efforts to." Where they list timeframes or operational commitments (response times, notice windows, opt-out flows), those are typical targets that we aim to meet, not promises that bind us in every case. We reserve the discretion to adjust operational practices as the Service, the legal landscape, and the threat landscape evolve. If you believe we have fallen short, write to [email protected] and we will work in good faith to resolve it.
2. The Service
LaxIQ.net is a platform for lacrosse training, education, and team development. Currently available functionality includes the public marketing site, the blog, the early-access waitlist, the IQ-quiz lead capture flow, and a Coach CRM available to authorized accounts.
Planned functionality includes IQ quizzes, drill libraries, goal tracking, team rosters and assignments, parent-side tools, leaderboards, AI-assisted features, and similar capabilities. Planned functionality is not part of the current Service. See Section 1.
AI-assisted features
Some current or future features may use artificial intelligence and machine learning (collectively, "AI Features"). Examples include AI coaching prompts, drill or quiz recommendations, content summarization, and similar. By using AI Features, you agree to the following:
- Opt-in and revocable. AI Features that process your personal information beyond basic account use are opt-in. You can opt out at any time, and we will use reasonable efforts to stop using your individual data for those features going forward, subject to backup-rotation timing and any data already mixed into prior model evaluations.
- Local-first when feasible. We prefer on-device or self-hosted AI where it is reasonably practical. We cannot guarantee that every AI Feature runs locally; some will rely on hosted AI providers listed in our Privacy Policy.
- Output may be wrong. AI output can be inaccurate, incomplete, biased, outdated, or unsafe. Do not rely on AI Features for medical, safety, coaching, legal, or financial decisions. Treat AI output as a starting point, not an answer.
- Improvement of our models. When you opt in, we may use your prompts, responses, feedback, and ratings to improve LaxIQ.net's own models, evaluation, and prompt design. We do not knowingly use the content of users known to be under 13 for this purpose.
- Hosted-AI risk. Hosted AI services have been the subject of bugs, data leaks, prompt-injection attacks, and rapidly evolving threats. We make a best-effort commitment, not a guarantee, that data sent to hosted AI providers stays private. By opting in to AI Features, you accept this residual risk.
We may add, change, or remove AI Features and AI providers at any time. We aim to update the Privacy Policy when material changes occur and, where reasonably practical or legally required, to request your renewed opt-in before sending your data to a new hosted provider.
Use at your own risk
The internet, AI, and connected platforms in general carry risk that grows and changes over time. Bots, automated attackers, AI-generated attacks, and data-leakage vectors evolve every day. We do our best to keep the Service secure, but the Service is provided on a best-effort basis. By creating an account or submitting information, you acknowledge that you are doing so at your own risk and that no guarantee of security, privacy, accuracy, or availability is implied beyond what these Terms and the Privacy Policy expressly state.
3. Eligibility & Accounts
Age
You must be at least 13 years old to create an account or submit information directly to the Service. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service.
Children under 13 may not create accounts or submit information directly. Parents and coaches may create limited player profiles for children under 13 through their own verified adult account, subject to the Privacy Policy and our COPPA handling.
Account creation
You agree to:
- Provide accurate information.
- Keep your password and login credentials secure.
- Notify us promptly of any unauthorized use of your account.
- Be responsible for all activity under your account.
Account types
We may offer different account roles (Player, Parent, Coach, Program Manager) with different capabilities. You agree to use only the role that accurately describes your relationship to the team or program.
4. Acceptable Use
You agree not to use the Service to:
- Violate any law or regulation.
- Infringe anyone's intellectual property, privacy, or publicity rights.
- Harass, bully, threaten, or harm other users, including any minor.
- Upload malware, viruses, or any code intended to harm or disrupt.
- Spam, send unsolicited communications, or scrape the Service in bulk.
- Impersonate another person or misrepresent your role or relationship to a team.
- Interfere with the operation, security, or integrity of the Service.
- Access another user's account without permission.
- Attempt to reverse engineer, decompile, or extract source code from the Service.
We may investigate, suspend, or terminate accounts that violate these rules.
5. User Content & License
You keep ownership of any content you submit to the Service ("User Content"), including profile information, drill notes, photos (if uploads are enabled), comments, and similar.
By submitting User Content, you grant LaxIQ.net a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and create derivative works of that User Content solely as necessary to operate, secure, and improve the Service and to provide it to other users you choose to share with (such as your team and coach). This license ends when you delete the content, except for (a) backup copies that purge in our normal rotation, (b) copies retained to comply with legal obligations, and (c) anonymized or aggregated data that no longer identifies you.
You represent that you own or have the rights necessary to submit your User Content and that the content does not violate any third-party rights or applicable law.
Profile visibility
Every player profile has two views, and you control them independently:
- Team / Coach / Parent View is the default and is always available to your team, coaches, and (for under-13 players) the adult account holder. It contains the full profile, including contact info, positions, stats, photos, and emergency contact.
- Community View is a trimmed-down public version of your profile that any LaxIQ.net user can see. It is off by default and only becomes visible after you explicitly publish it. The Community View hides contact information, emergency contact, exact address, and any stats you choose to keep private.
You can publish, unpublish, or modify these visibility settings at any time through your profile settings. Unpublishing takes effect within a reasonable time and removes your profile from the public Community View. Cached and backup copies purge in our normal rotation. Information that is never visible publicly, regardless of your visibility settings: email address, phone number, home address, emergency contact, and payment information. These remain visible only to admins of teams you are on, and to LaxIQ.net staff for support purposes.
6. Feedback
If you send us feedback, ideas, suggestions, bug reports, or survey responses, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that feedback into the Service and any related products, without compensation or attribution. Don't share anything you consider proprietary.
7. DMCA / Copyright Complaints
We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a written notice to our designated agent at [email protected] with the subject "DMCA notice" containing:
- An identification of the copyrighted work claimed to be infringed.
- An identification of the material that is allegedly infringing, with enough detail to find it (URL is best).
- Your contact information (name, address, phone, email).
- A statement that you have a good-faith belief that the use is not authorized.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on the rights holder's behalf.
- Your physical or electronic signature.
We may remove content in response to valid notices and may terminate repeat-infringer accounts. Counter-notices follow the procedure in 17 U.S.C. § 512(g).
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Subscriptions, Pricing, and Payments
The Service is currently free to use. No paid subscriptions are offered during early access. The Support page allows voluntary pledges of intent that are not charged. See the Early-Access Terms.
When and if paid subscriptions launch, the Refund Policy will govern those transactions. Pricing, plans, billing cycles, and trial offers will be described on the Service before any charge is initiated. We will obtain your explicit authorization before charging your payment method.
10. Intellectual Property
Except for User Content, the Service and all of its software, design, text, graphics, logos, icons, audio, and video are owned by or licensed to LaxIQ.net and are protected by copyright, trademark, and other laws.
You may not, without our written permission:
- Copy, modify, distribute, or create derivative works of the Service.
- Reverse engineer or scrape the Service.
- Use our trademarks, logos, or branding.
- Frame, mirror, or republish the Service or its content.
11. Service Availability
We try to keep the Service available, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, technical issues, third-party-provider outages, or events outside our control. We are not responsible for outages caused by your network, device, or third-party services you use to access the Service.
12. Disclaimers ("AS IS")
The Service is provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, we disclaim all warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, accuracy, completeness, uptime, error-free operation, or uninterrupted access.
Content on the Service (drills, training notes, quiz questions, strategy material, blog posts) is educational. It is not medical, safety, coaching, legal, or financial advice. Use your own judgment and consult qualified professionals before acting on it. You are solely responsible for any decisions you make based on Service content.
AI-specific disclaimers. AI Features may produce output that is inaccurate, incomplete, biased, outdated, fabricated, or unsafe. We make no warranty that AI output is correct, factual, current, or fit for any purpose. We make no warranty that data you submit to a hosted AI provider will not be exposed by a vulnerability, prompt-injection attack, or other threat outside our control. By opting in to AI Features, you accept these specific risks in addition to the general "AS IS" disclaimer.
Evolving threat landscape. Online services and AI capabilities, including the threats against them, change rapidly. We commit to a best-effort security posture, not a guaranteed one. You acknowledge that no service can promise immunity from emerging attacks.
13. Limitation of Liability
To the maximum extent permitted by law, in no event will LaxIQ.net, the Operator, or any contributor be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, revenue, goodwill, or business opportunity, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
This includes, without limitation, damages arising from: AI Features and AI output (including incorrect, biased, or unsafe output); data leakage, prompt-injection attacks, or other vulnerabilities affecting hosted AI providers or other subprocessors; bot activity, automated attacks, or AI-generated attacks against the Service; and security incidents at any third party we rely on.
Our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) one hundred United States dollars ($100). During the early-access period, the Service is provided free of charge, so this cap will be the $100 floor. The Early-Access Terms set a stricter zero-dollar cap during early access; that stricter cap controls during early access.
14. Indemnification
You agree to defend, indemnify, and hold harmless LaxIQ.net, the Operator, and any contributors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service.
- Your User Content.
- Your violation of these Terms or any applicable law.
- Your violation of any third-party right (including intellectual property, privacy, or publicity rights).
We may, at our option, assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us at your own expense.
15. Termination
You may stop using the Service at any time. You may delete your account by following the instructions on the Service or by writing to [email protected].
We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we reasonably believe you have violated these Terms, the law, or the rights of others, or if continued access poses a security or legal risk. We may also terminate or suspend the Service, or any feature, in our discretion.
Sections that by their nature should survive termination will survive, including User Content license (to the extent of the residual rights described in Section 5), Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and these survival provisions.
16. Dispute Resolution: Arbitration & Class-Action Waiver
Please read this section carefully. It affects your legal rights.
You and LaxIQ.net agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") through binding individual arbitration, not in court, except as stated below.
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Orange County, Florida, or by remote hearing at the arbitrator's discretion. The arbitrator may award the same individual relief a court could. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and LaxIQ.net agree that any Dispute will be brought on an individual basis only. You waive the right to participate in a class action, class arbitration, consolidated action, or representative action against LaxIQ.net.
Exceptions. Either party may bring a claim in small-claims court if the claim qualifies. Either party may seek injunctive or equitable relief in court for infringement or misuse of intellectual property rights. These exceptions do not waive the right to arbitrate other claims.
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with the subject "Arbitration opt-out," your name, and the email address on your account. Opting out will not affect any other part of these Terms.
If any portion of this Section 16 is held unenforceable, the remainder will still apply, except that the class-action waiver is non-severable. If the class-action waiver is found unenforceable, the entire arbitration provision will be void.
17. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. For Disputes that are not subject to arbitration under Section 16, the exclusive venue is the state and federal courts located in Orange County, Florida, and you consent to personal jurisdiction there.
18. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications failures, third-party-provider outages, or pandemic.
19. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force. The invalid or unenforceable provision will be reformed to the minimum extent necessary to make it enforceable while preserving its intent.
20. Entire Agreement; Assignment
These Terms, together with the Privacy Policy, the Early-Access Terms (where applicable), and the Refund Policy (when paid offerings exist), are the entire agreement between you and LaxIQ.net regarding the Service and supersede any prior agreements.
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, with notice to you.
21. No Waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
22. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. For material changes, we will provide reasonable notice (typically by posting a notice on the Service and, for registered users, sending an email). Continued use of the Service after a material change becomes effective means you accept the updated Terms.
